Terms and Conditions of Hot Tub Hire
These Terms and Conditions (“Agreement”) govern the hire of hot tub equipment and
associated accessories (“Equipment”) by Jorvik Hot Tub Hire LTD (“the Company”) to
the customer (“the Hirer”). By placing a booking, the Hirer agrees to be bound
by the following provisions.
1. Formation of Contract
1.1 A
binding contract is formed upon acceptance of the Hirer’s booking request and
receipt of the required deposit.
1.2 The Company reserves the right to decline any booking at its sole
discretion.
2. Payment
2.1 A
non-refundable deposit of 20% of any booking shall be payable at the time of
booking.
2.2 The balance of the hire fee shall be payable on the day of delivery.
2.3 Failure to make payment in full shall entitle the Company to cancel the
booking without liability.
3. Cancellations
3.1
Deposits are strictly non-refundable.
3.2 If the Hirer cancels more than 14-30 days before delivery, the Company may
refund up to 100% of the deposit.
3.3 Cancellations within 5-10 days of delivery shall result in forfeiture of
the entire hire fee.
3.4 The Company reserves the right to cancel the hire due to circumstances
beyond its control, including but not limited to: equipment failure, adverse
weather conditions, or safety concerns. In such event, the Hirer shall be
entitled to a full refund of monies paid, which shall constitute the Hirer’s
sole remedy.
4. Delivery, Installation and Collection
4.1 The
Hirer shall ensure that adequate access is available for delivery and
installation. Failure to provide sufficient access may result in cancellation
without refund.
4.2 The Hirer shall be present at the agreed times of delivery and collection.
4.3 Once installed, the Equipment must not be moved, modified, or tampered with
by the Hirer.
4.4 Risk in the Equipment shall pass to the Hirer immediately upon delivery and
shall remain with the Hirer until collection by the Company.
5. Hirer Obligations
The Hirer
undertakes and agrees:
5.1 To provide a suitable level, stable, and safe location for installation.
5.2 To ensure availability of a suitable water supply and drainage.
5.3 To provide a safe and compliant electricity supply (13amp RCD-protected
socket).
5.4 To ensure that the Equipment is used only for its intended purpose.
5.5 To supervise all users of the Equipment and ensure that children under 16
years are supervised by a responsible adult at all times.
5.6 To comply strictly with all operating and safety instructions supplied by
the Company.
6. Safety and Use
6.1 The
Hirer acknowledges that the use of the Equipment involves inherent risks and
undertakes to ensure safe operation.
6.2 Persons with health conditions (including but not limited to heart
conditions, pregnancy, high/low blood pressure, or skin conditions) must seek
medical advice prior to use.
6.3 The Equipment must not be used by any person under the influence of
alcohol, drugs, or medication that may impair judgment.
6.4 Glassware is strictly prohibited within or in the vicinity of the hot tub.
6.5 The maximum bather capacity as advised by the Company must not be exceeded.
6.6 The Hirer shall be solely responsible for ensuring safe use of the
Equipment during the hire period.
7. Chemicals and Water Quality
7.1 The
Company shall provide necessary chemicals and usage instructions.
7.2 The Hirer accepts full responsibility for the safe and proper use of
chemicals.
7.3 Failure to maintain correct chemical balance may result in health risks
and/or damage to the Equipment, for which the Hirer shall be liable.
7.4 If the water becomes contaminated due to Hirer negligence or misuse, the
Hirer shall be responsible for draining and refilling at their own cost.
8. Damage, Loss and Insurance
8.1 The
Hirer shall be liable for any damage, theft, loss, or misuse of the Equipment
during the hire period, howsoever caused.
8.2 A refundable security deposit may be required prior to delivery. The
deposit shall be returned following collection provided the Equipment is
returned in a clean, undamaged, and serviceable condition.
8.3 The Hirer shall not carry out or permit any repair or modification to the
Equipment.
8.4 The Company shall not be liable for any damage to property, surfaces, or
landscaping caused by the weight of the Equipment, water discharge, or
installation.
9. Liability and Indemnity
9.1 The
Company shall not be liable for any death, personal injury, illness, loss, or
damage arising from the Hirer’s use or misuse of the Equipment, except where
such liability cannot be excluded by law.
9.2 The Hirer hereby indemnifies the Company against all claims, liabilities,
costs, damages, and expenses arising from the Hirer’s breach of this Agreement
or misuse of the Equipment.
9.3 The Hirer acknowledges that it is their responsibility to obtain suitable
insurance coverage during the hire period.
10. Termination of Hire
10.1 The
Company reserves the right to terminate the hire immediately and recover the
Equipment without refund if:
(a) the Hirer breaches any term of this Agreement;
(b) the Equipment is being misused; or
(c) the Company considers continued use unsafe.
11. Force Majeure
11.1 The
Company shall not be liable for any delay, cancellation, or failure to perform
its obligations due to events beyond its reasonable control, including but not
limited to extreme weather, strikes, power failure, or equipment breakdown.
12. Governing Law
12.1 This
Agreement shall be governed by and construed in accordance with the laws of
England and Wales.
12.2 The parties submit to the exclusive jurisdiction of the English courts in
respect of any dispute arising under this Agreement.
Execution
of booking and/or payment of deposit constitutes full acceptance of these Terms
and Conditions
Health & Safety Rules
To ensure
the safe and enjoyable use of your hot tub, please read and follow the rules
below. These must be observed at all times during your hire period.
Supervision & Age Restrictions
- Children under 16 must be
supervised by a responsible adult at all times. - Hot tubs are not suitable
for children under 5 years of age. - Only children tall enough to
stand on the bottom with their head fully above the water level may use
the hot tub, and only with an accompanying adult.
Alcohol, Drugs & Smoking
- Do not use the hot tub under
the influence of drugs or excessive alcohol. Impaired judgment increases
the risk of accidents, unconsciousness, and drowning. - Smoking in or around the hot
tub is strictly prohibited as it can cause fire risks and damage.
Safe Use of the Hot Tub
- Limit use to 20 minutes
per session to avoid overheating (hyperthermia). Water temperatures
can reach up to 40°C. Take breaks to regulate body temperature. - Do not submerge your head
underwater or attempt to drink/swallow the water. - Never use electrical
appliances in or near the hot tub. This is extremely dangerous. - Do not place the hot tub
cover on while anyone is inside. - The cover must be securely
replaced when the hot tub is not in use to prevent accidents or drowning.
Health Conditions
- Do not use the hot tub if
you are pregnant, or suffer from medical conditions such as diabetes,
obesity, high or low blood pressure, cardiovascular disorders, skin
conditions, epilepsy/fits, or immune system concerns, without first
seeking medical advice. - Do not use the hot tub
immediately after strenuous exercise or immediately after eating. - Persons with any infectious
disease must not use the hot tub.
Cleanliness & Hygiene
- Always shower and use the
toilet before entering the hot tub. - Do not add any detergents,
soaps, oils, bubble bath, or foaming agents — these damage the filters and
make the hot tub unsafe for use. - Do not use the hot tub if
wearing fake tan, as it will contaminate the water and damage the filter
system. - If anyone experiences an
allergic reaction while in the hot tub, exit immediately and seek medical
advice if symptoms persist.
Other Rules
- Pets are not permitted in or
near the hot tub. - Only use the hot tub as
instructed during delivery and handover. - If you have any concerns or
